被征收人在法定期限内不申请行政复议或者不提起行政诉讼，在补偿决定规定的期限内又不搬迁的，由作出房屋征收决定的市、县级人民政府依法申请人民法院强制执行。
《国有土地上房屋征收与补偿条例》第二十八条规定：被征收人在法定期限内不申请行政复议或者不提起行政诉讼，在补偿决定规定的期限内又不搬迁的，由作出房屋征收决定的市、县级人民政府依法申请人民法院强制执行。强制执行申请书应当附具补偿金额和专户存储账号、产权调换房屋和周转用房的地点和面积等材料。
因此，可以看出如果被征收人对房屋拆迁有异议，在法定期限内应申请行政复议或提起行政诉讼，否则被征收人应当在补偿协议约定或者补偿决定确定的搬迁期限内完成搬迁。若不搬迁，则有关机关可申请人民法院强制执行。
